Brian J. Malloy is a Phi Beta Kappa graduate of the University of Oregon, Robert D. Clark Honors College, where he graduated summa cum laude. Brian attended the University of California, Hastings College of the Law, earning Order of the Coif, and graduating as Valedictorian. Prior to joining The Brandi Firm, Brian served as a law clerk to the Honorable Melvin Brunetti of the United States Court of Appeals for the Ninth Circuit.
Brian is admitted to the bars of California, Nevada, Arizona, and Washington, D.C., along with numerous federal courts, including the United States Supreme Court. He has represented clients in both state and federal courts in complex product liability matters involving aviation and aircrafts, motor vehicles, pharmaceuticals, medical devices, and other defective products. Brian has also represented clients in matters involving severe personal injury, wrongful death, dangerous condition of public property, physical and financial elder abuse, consumer fraud and protection, financial fraud, and class actions.
Brian has experience in all areas of litigation, including all aspects of discovery, successfully filing and opposing dispositive motions, trials to verdict in California and Nevada state courts as well as federal court, post-judgment enforcement proceedings, and appeals. Examples of some of his recent experience include:
- Appointed Collective Action Counsel in a national wage and hour action and obtained summary judgment in favor of the employees holding that the employees were entitled to overtime pay (Campanelli, et al. v. The Hershey Company, 765 F.Supp.2d 1185 (N.D.Cal. Feb. 23, 2011));
- Substantial involvement at trial and on appeal regarding a $15 million jury verdict on behalf of man who was rendered a quadriplegic as a result of a defective vehicle, which was recently affirmed by a federal appeals court (Pierson v. Ford Motor Company, 455 Fed.Appx. 966 (9th Cir.Aug.04, 2011));
- Represented families of those who died or individuals who were seriously injured in accidents involving aircrafts, buses, taxi cabs, trucks, autos, and by drunk drivers, including a $2 million settlement on behalf of a woman seriously injured when she was struck in a crosswalk by a bus, a $1.3 million settlement on behalf of a woman seriously injured when a taxi cab in which she was a passenger collided with a van driven by an employee of three companies, and a $650,000 settlement on behalf of a woman seriously injured in an auto accident;
- Represented families of firefighters who died in a helicopter crash, resulting in a confidential settlement;
- Represented individuals injured by Actos, Fosamax, Avandia and Vioxx prescription drugs and Guidant and Medtronic medical devices in state and federal coordinated actions;
- Represented members of the military and their families in several cases against government contractors involving serious injury or death;
- Challenging a banks practice of seizing Social Security funds from elderly and disabled consumers;
- Successful enforcement of an over $12 million judgment against government agency who refused to satisfy judgment even after being held in contempt of court.
Brian has been selected to Northern California Rising Stars in 2010 and 2011 by Super Lawyers. He has also authored a number of articles on various aspects of litigation. He is a member of the Bar Association of San Francisco where he serves on the Barristers Club Pro Bono and Community Service Committee, and he is also a member of the Ninth Judicial Circuit Historical Society. Brian also serves as General Counsel and Board Member for The Tony Patiño Fellowship, a nonprofit organization that awards law-school scholarships at U.C. Hastings, the University of Chicago and Columbia University. A native of Eureka, California where he graduated from Saint Bernard High School, Brian lives in San Francisco with his wife.
