Yesterday, a New Jersey jury rejected Johnson and Johnson’s attempt to escape responsibility for its malicious conduct and returned a punitive damage verdict of $7.76 million for Linda Gross, a 47 year-old nurse who was severely injured by Johnson and Johnson’s Ethicon vaginal mesh implant. The jury obviously felt that when looking at all of the evidence of the neglectful conduct of Johnson and Johnson that a punitive damage verdict was necessary to punish the conduct, and hopefully deter similar future behavior. The verdict sends a strong message to the pharmaceutical industry to provide safe products and to be truthful in their dealings with doctors and consumers, or suffer the consequences.
